Mediation is a smarter alternative to a costly litigation because of the substantial savings in time and money that it affords the parties. In addition, divorce mediation allows you to solve your property and custody issues in a less stressful, private, confidential manner, guided by a former Superior Court Family Court Judge with seven years experience. Marcia has extensive experience in family law and sensitivity to all issues surrounding the legal separation and divorce process.
ARBITRATION
There are some instances where the parties may not want to have their matters heard in a public courtroom. In that case, arbitration may be a viable solution to obtain a final judgment in their case. The matter is tried with a private “judge” at the convenience of the parties and a final decision rendered in a much more efficient manner than if the parties had engaged in traditional litigation.
APPEALS AND MOTIONS
Any time a family court makes a ruling regarding issues like child custody, child support, equitable distribution, alimony, etc, it may be possible to modify that order if certain circumstances change after-the-fact, or alternatively, appeal that order in a higher court. However, there are very specific timelines regarding when an appeal must be filed, and stringent rules and requirements in order for the process to be successful. Any time you are pursuing an appeal of a family court order, it is highly recommended that you retain experienced legal counsel to advise you of your options, help you comply with the many requirements of the courts, and work with you towards resolving the issue in your favor.
